A Man who sustained life-threatening injuries was mouthing abuse shortly before he was hurt, a court has heard.
In connection with the Matthew John Jarvis case, witness Lee Benson told Hull Crown Court yesterday that Adam Saunders and his brother, Daniel, were abusive towards him.

Mr Benson was giving evidence in the trial of Mr Jarvis, 25, who is accused o
f inflicting grievous bodily harm on Adam Saunders in the early hours of February 17.

Mr Jarvis, of The Chase, Driffield, has pleaded not guilty to the charge.

Mr Saunders, 28, sustained serious head injuries in an incident in Driffield and the court was told that he has been left with a major and permanent disability.

While being questioned by prosecution barrister Andrew Dallas, Mr Benson, who had been on a night out in Driffield, said he asked two men involved in an argument over chips in the Ranch takeaway to calm down.
He said: "I thought that it was getting out of hand and asked them to calm it down.

"They asked what it had to do with me but it seemed to calm down and I shook one of the gentleman's hands.

"I went outside for a cigarette while I was waiting for my food order and the two gentlemen were mouthing abuse towards me."

Mr Benson told the court he went to the car park with one of the men, Daniel Saunders, who hit him and they ended up fighting on the ground.
Mr Benson, who sustained injuries in the fight, said that while he was still on the ground he heard someone shout: 'Get an ambulance'.He got to his knees and saw someone lying on the floor.

Earlier, the court heard that it was the Crown's case that Matthew Jarvis had punched Adam Saunders causing bruising and obvious swelling to his upper lip.

Mr Dallas said no witnesses claim to have seen a punch, but a pathologist had concluded Adam Saunders' fall had been consistent with a single blow to the face.
